National Pension Services provides third-party retirement plan administration services, including but not limited to plan design, IRS reporting, compliance testing, participant recordkeeping, and related consulting services. Our services are intended for businesses and plan sponsors.
Access to our client portal and administrative tools is provided solely for authorized users of active client accounts. We reserve the right to modify, suspend, or discontinue any aspect of our services at any time with reasonable notice.
3. Account Terms
To access certain features of our platform, you must create an account. You are responsible for:
- Maintaining the confidentiality of your account credentials
- All activities that occur under your account
- Providing accurate and complete registration information
- Notifying us immediately of any unauthorized use of your account
NPS reserves the right to terminate accounts that violate these Terms or that have been inactive for an extended period.
4. Acceptable Use
You agree not to use our services to:
- Violate any applicable laws or regulations
- Transmit any harmful, fraudulent, or deceptive content
- Interfere with or disrupt the integrity or performance of our systems
- Attempt to gain unauthorized access to any portion of our platform
- Reverse engineer or attempt to extract source code from our software
- Use our services for any purpose other than legitimate retirement plan administration
5. Data and Privacy
Your use of our services is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using our services, you consent to the collection and use of your information as described in the Privacy Policy.
We handle sensitive financial and personal data in connection with retirement plan administration and are committed to protecting that data in accordance with applicable law.
6. Intellectual Property
All content, software, trademarks, logos, and other intellectual property on our platform are owned by or licensed to National Pension Services. You may not reproduce, distribute, or create derivative works without our express written permission.
You retain ownership of data you submit through our platform. By submitting data, you grant us a limited license to use that data solely to provide our services to you.
7. Limitation of Liability
To the maximum extent permitted by law, NPS shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising from your use of our services.
Our total liability for any claim arising out of or relating to these Terms shall not exceed the amount paid by you for the services in the twelve (12) months preceding the claim.
8. Termination
Either party may terminate the service relationship upon written notice. Upon termination, your right to access the platform will cease. We will retain your data for a period as required by applicable law and as described in our Privacy Policy, after which it will be securely deleted.
9. Modifications to Terms
We reserve the right to update these Terms at any time. We will notify you of material changes by posting the updated Terms with a new effective date and, where appropriate, by sending an email notification. Continued use of our services after changes take effect constitutes acceptance of the revised Terms.
10. Governing Law
